A poorly handled separating can have long-term effects (How To Fire Someone)

The consequences of ignoring a bad employee. Written reprimand & termination forms.

A poorly handled separating can have long-term effects for the company and its ability to keep good employees. Document the business rationale for the lay off. But this is the nature of negotiation. Here's the guideline approach you'll find in most books: To keep out of court, you should thoroughly document the worker's lackluster performance or misbehavior before you separate him. By targeting the problem early, having a paper trail, and writing a notice of lay off for cause, the firing will not be as difficult. If a law suit is filed, this wastes more firm resources. You also need to prepare for the severance terms you are willing to offer and prepare the layoff memorandum and separation agreement. 1) Probably this problem individual has good performance evaluations done by your predecessor. Dating back to 1915, employers have included a pink slip with the pay stub notifying the jobholder of their separation.

It's difficult to layoff anyone, but a good letter can ease the pain of a sacking. However in the low-risk case, it's unlikely that a jobholder will sue or a legal counsellor will take her case. But when the problem employee listed a false employer, then you can dismiss immediately. As a reminder, when you layoff the worker on the account of "firm needs," you can't refill the position for at least a year, or you risk the worker bringing a wrongful termination suit. After writing the dismissal memorandum, you must draft the separation document for medium and high risk terminations. But, if you're cutting the job owing to economic conditions and competitive pressure, dismiss the employee and negotiate a release of claims after the fact. After everyone finishes testifying, the hearing officer will ask you and the worker for closing remarks.
