Get a legal counsellor involved if you face something similar. In several court cases, juries have signaled that giving "one chance" for gross misconduct is fair and reasonable for long-tenured personnel. (You won't be surprising anyone in the organization. And using this information, you can address concerns that your present and future workforce may have about your work environment. If the worker is a hazard to any company and its workforce (such as prone to violence or theft), then it's your duty to include this in your notice and phone references. Be brief but support your case for separation. For example, you would like your separation notice to reflect the business and your position, not someone else's.
