A good company cannot run with personnel that do not want to perform their work. A sample layoff notice will ensure you cover important areas and stay within the lay off law. Also, you may want an Hr manager or a legal adviser to review it. They made some innocent mistake during the layoff such as saying the wrong thing at the wrong time during the dismissal meeting. For example your worker may be Muslim, Jewish, Buddhist or any other religious affiliation that doesn't recognize Christmas. If you can, document the effect their absence or their rationale for being in jail is having on your small business. By giving a formal notice, employers can hope to change the employee's direction and have them become productive again. In these situations, it is more efficient to counsel person employees about their expected standards of behavior, and how they have acted wrongly. However in the low-risk case, it's unlikely that a jobholder will sue or a legal adviser will take her case. As an example, your risk of separating is much less when the jobholder has punched his supervisor in the face - than when you separate a high-performing 60-year-old employee to give your daughter-in-law his job. If you ask the worker to do work within his or her job description and within firm policy, the jobholder should comply.

Have the jobholder sign the letter so there is a record that you did meet with the jobholder and presented the information recorded in the reprimand notification. LOW RISK Separations - You only offer your standard severance (if any) and you don't need a release. If necessary, the dismissal letter may need to explain retirement accounts or life insurance policies or specify who can help with transferring these benefits. For example if an employee refuses to operate equipment for which they are not trained to cover for a coworker, this is not insubordination.
